Doctors Found Guilty For Failing To Treat HIV Patients at Clinics in Miami
U.S. District Judge Paul C. Huck today sentenced Dr. Isaac Nosovsky, of Weston, to 65 months in prison and ordered him to pay $1.3 million in restitution. Nosovksy was convicted of conspiracy and health care fraud in May for his role in the scheme. When released from prison, Nosovsky will be on supervised release for 3 years. Nosovsky was connected with International Medical Clinic, a Miami medical clinic that was supposed to treat AIDS/HIV-infected patients. Nosovksy was accused of pre-signing medical documents in 2004 and 2005 that indicated that the patients at the clinic had been treated when in fact they had not.
Medicare paid the clinic approximately $1.3 million for expensive treatments supposedly ordered by Nosovksy and never administered to the patients. Evidence presented at Nosovsky’s trial showed that he received approximately $160,000 for his four months of participating in the scheme. Last month, Judge Huck sentenced Adela Faustina Gonzalez, a co-defendant in the case involving Nosovsky, to 24 months in prison.
FBI agents today arrested Frantz Achille, a Miami physician, charged in a separate indictment in connection with the same scheme. According to the Indictment, Achille was a doctor at International Medical Clinic and a Miami clinic that operated under his name. The Indictment alleges that in 2005, Achille and co-conspirators falsified medical paperwork in order to justify bills to Medicare for expensive HIV treatment medications. The Indictment charges that the patients did not receive the treatments and were paid bribes to come to the two clinics. Achille was charged with one count of conspiracy and seven counts of health care fraud. The maximum punishment on each count is 10 years’ imprisonment.
